OUR COMPANY

BAUM Cosmetics SNC sells, via its online shop https://baumextreme.com, natural cosmetic products handmade in Switzerland in a cosmetics workshop.

PRODUCTS

The Products offered for sale by BAUM Cosmetics are those displayed on the Website on the day it is viewed by the User, and subject to availability. If a Product is unavailable, the customer will be informed as soon as possible by email or telephone.

Photographs and texts illustrating the Products are not contractually binding.

BAUM Cosmetics SNC makes every effort to provide carefully handmade natural cosmetic products, manufactured in accordance with good practice and the “Good Manufacturing Practices”.

BAUM Cosmetics asks the Customer to note that, as our cosmetic products are natural and artisanal, slight differences from one batch to another — such as minor variations in texture — are normal.

Our cosmetic products comply with Swiss and EU standards and are tested by a dermatologist in an accredited laboratory, on a sample of 10 to 11 people for 48 hours.

We do not fragrance our products with essential oils. However, we do sell pure, natural, organic-quality essential oils. Essential oils are very concentrated. It is therefore always necessary to carry out a patch test in the crook of the elbow and to check that no allergy occurs. In the event of an allergy, do not use the essential oil and report it by email to BAUM Cosmetics SNC: info@baumextreme.com.

Pregnant women, breastfeeding women and children under 6 years of age must not use essential oils. Essential oils must be kept out of the reach of children and animals.

LIABILITY

As any substance, whether natural or not, is active, the total or partial inability to use a BAUM all naturals® Product — for example due to intolerance or allergy — shall not give rise to any compensation, refund, or liability of BAUM Cosmetics SNC or of its brand BAUM all naturals®.

BAUM Cosmetics / BAUM all naturals® shall be liable only for direct damage which the customer proves was caused by serious fault on the part of BAUM Cosmetics SNC, for example where a manufacturing defect has been duly established.

If BAUM Cosmetics SNC is held liable, liability is limited to a refund of the price of the product concerned or to its replacement by another Product, at the customer’s choice.

CUSTOMERS

These Terms and Conditions of Sale apply without restriction or reservation to all sales of Products offered by BAUM Cosmetics under its registered trademark BAUM all naturals®, and concluded solely on the website https://www.baumextreme.com with consumers.

Our general terms and conditions of sale may be printed and kept by the Customer.

The Customer has the legal capacity to place an order. BAUM Cosmetics SNC is not required to verify the Customer’s legal capacity to place an order.

Consequently, by ordering a Product offered for sale on https://www.baumextreme.com, the Customer fully and unreservedly accepts these General Terms and Conditions of Sale, which the Customer acknowledges having read before placing the order.

PRICES

The selling price of the Products available on https://www.baumextreme.com is the price in force at the time the order is placed.

These prices do not include shipping costs, which are charged in addition to the price of the Products purchased, according to the terms set out below and as indicated to the Customer before the order is confirmed, or customs duties, which are payable by the Customer. Products are payable at the time of order, including shipping costs, before dispatch. Prices may change at any time according to market conditions.

Delivery and shipping costs

Information on Product availability is provided at the time of ordering, where applicable.

In Switzerland, shipping costs amount to CHF 7 for any order under CHF 100. For any order over CHF 100, shipping is free.

For any order outside Switzerland, within the EU, the applicable rate is CHF 18 per order for 1 kg. Transport costs may vary according to the weight of the order.

IMPORTANT: Customs duties and any other additional charges that may be levied upon entry into certain countries remain the sole responsibility of the customer.

Delivery is made by postal parcel via Swiss Post. Any available item is in principle shipped within 2 to 5 working days (weekends and public holidays excluded).

If BAUM Cosmetics SNC is unable to deliver the ordered Products within the stated period, the Customer will be informed by email of the new delivery date. If this period exceeds 10 days, the customer may cancel the order by email to info@baumextreme.com, stating the order details.

This cancellation will be taken into account provided it reaches BAUM Cosmetics 24 hours before the ordered goods are handed over to the Post. Otherwise, the order can no longer be cancelled.

In the event of an unclaimed parcel, BAUM Cosmetics SNC cannot be held liable and any reshipping costs shall be borne by the Customer. Before any reshipment, BAUM Cosmetics SNC may require the Customer to pay the related costs in advance by bank transfer to BAUM Cosmetics’ account. If the Customer does not respond within one month of the transfer request being sent, BAUM Cosmetics reserves the right to cancel the order.

CONCLUSION OF THE SALES CONTRACT

When ordering via www.baumextreme.com, the ordering process comprises 3 steps:

The Customer selects the desired goods.

The Customer provides the delivery address and selects the desired payment method. In the Canton of Geneva only, payment may be made upon delivery of the Products.

The Customer submits the order and receives an email confirming receipt of the order.

The Customer warrants that only accurate information has been provided and shall be liable to BAUM Cosmetics SNC for any damage arising from incorrect information (such as impossibility of delivery due to an error in the address given by the Customer).

The order placed by the Customer constitutes a firm offer to conclude a purchase contract, according to the ordering terms provided by BAUM Cosmetics SNC. Once confirmed by the Customer, the order cannot be withdrawn without acceptance of a formal cancellation request sent by email to info@baumextreme.com.

BAUM Cosmetics SNC reserves the right to accept or refuse, without stating reasons, any request by a Customer to cancel an order. BAUM Cosmetics SNC communicates its decision of acceptance or refusal by email to the address given by the Customer in the order. In the event of cancellation, the Customer’s claims are limited exclusively to a full refund of the payment made.

RETURNS AND REFUNDS

Upon receipt of the order, the Customer must immediately inspect the goods delivered in order to identify any apparent defects (product delivered not corresponding to the product ordered, packaging defect, missing products, etc.). The Customer must check the conformity of the goods delivered within 8 days and immediately notify BAUM Cosmetics SNC by email at info@baumextreme.com in the event of non-conformity or defect.

In such a case, the customer returns the non-conforming goods in their original container or packaging, unopened. The return of the goods must be preceded by acceptance of a return request submitted by the Customer to info@baumextreme.com.

For non-conforming products returned, the customer may choose one of the following two options:

a cash refund of the value of the defective product(s), or

replacement of the non-conforming product(s), by exchange for the same product(s) or by supply of another product of equivalent value to the initial order. Any price difference will be refunded if the replacement product costs less than the newly chosen Product. If a new Product of higher value than the defective Product is chosen, the price difference will be charged.

BAUM Cosmetics SNC is not liable for cosmetic products that are defective as a result of inappropriate use by the Customer.

PRICES AND MEANS OF PAYMENT

The prices in force are those indicated at the time of the order and are valid in Switzerland. They are expressed in Swiss francs and include all taxes applicable in Switzerland, valid for Switzerland.

An order via www.baumextreme.com requires advance payment of the order amount and related costs. The following are accepted:

The trademark “BAUM all naturals”, owned by BAUM Cosmetics SNC, is a registered trademark and may not be used without our prior written consent. The entire content of www.baumextreme.com, including photographs, images and texts, is the property of BAUM Cosmetics SNC. Its use is permitted only with the written consent of BAUM Cosmetics SNC. It is strictly prohibited to reproduce or represent all or part of the screens or information on our website on any other medium or for any other purpose.

Your personal data are collected, processed, used and stored by us in accordance with the applicable data protection laws, for the purpose of performing the contract.
